This is the introduction to a short essay in jurisprudence (fiqh) by the Imām and Hāfiẓ ‘Abdullāh ibn ‘Abdur-Rahmān ibn Abī Zayd al-Qayrawānī upon the treatise of which he authored concerning the jurisprudence (fiqh) of Imām Mālik.
It has always been from the norm of the Salaf (X) that whenever they would author books in jurisprudence (fiqh) they would begin by clarifying the creed (‘aqīdah). Thus, they would divide it into [two parts]:
1. The greater affairs of jurisprudence (fiqh) al-akbar) which is understanding the correct creed (‘aqīdah).
2. The branches of jurisprudence (fiqh) al-furū’) which is the understanding of how to worship Allāh and dealings with the people.

Al-Bukhari recorded a report from Abu Musa al-Ash’ari (may Allah be pleased with him) who narrated that the Messenger of Allah said, “The example of a person who makes dhikr of his Lord and a person who does not, is like that of a living and a dead person.”

If a person had no other distress or anguish before them except death, this would be sufficient to disturb their livelihood. Death is the reality of every soul and it is the destroyer of all pleasures. How strange is it indeed that a human is so immersed in worldly life; it’s delights, glitter, glamour, fame and power that they are heedless of a truth which is about to strike at any time, with no return.

It is related that Abu Hurairah said: “We were walking with the Messenger of Allah (sallallahu alaihi wa sallam) when we passed two graves. Then he stood still and we stood with him. His color started to change and he rolled up his sleeves, so we said: ‘What’s the matter, oh Prophet of Allah?’, he said: ‘Don’t you hear what I’m hearing?’ We said: ‘What is it, oh Prophet of Allah?’ He said: ‘These two men are being severely punished in their graves for a relatively minor sin.” We said: ‘For what are they punished, oh Prophet of Allah?’ He said: ‘One of them never used to clean urine from himself, and the other used to harm the people by his speech and walk amongst the people carrying tales.’ So he called for two palm stalks and he put one into each grave. We said: ‘Will this benefit them oh Messenger of Allah?’ He replied: ‘Yes, it will lighten their punishment for as long as it remains moist.'” Reported by Abu Hatim (3/106) in “Al-Ihsan”. And Sheikh Muqbil declared it as “good” in “Al-Jami’ As-Sahih mimma laisa fi As-Sahihain” (2/278-279).
